Can an inmate sue a prison if they are attacked by another inmate?

If the guards don’t do enough to protect the safety of an inmate, and the inmate gets beaten up or raped, can they sue the warden or the prison?

If the inmate can prove that the facility provided less that the ordinary effort to ensure safety, they could try to sue for negligence. It’s not impossible to win, just highly unlikely. That sort of violence is just part of the environment. Short of having everyone in solitary confinement 24/7, it can’t be completely elimanated.

Yes they can sue. Will they win is the important question. Typically that answer is no.
