The jail sentence starts when they say it starts, not one minute sooner.
In 1960 one of JFK’s first acts as President was to launch a "prison commission" to report on the state of prisons and chain gangs and other forced labor programs in the USA. His goal was partly to find out what had happened to thousands of Irish people who had disappeared after traveling south.
What he found was rather shocking.
Everyone knows that conserfatives aren’t nice people; one of their trademark sayings is nice guys finish last, after all. They adore nothing more than a "tough guy" who shoots first and looks under the hoop skirt later to see if the church lady just shot was really a "bad guy" (and usually decide they did the right thing anyway ~ people who don hoop skirts might be hiding something).
But in 1961 it became evident that unlike all the other Presidents who had learned they were surrounded by scoundrels in black robes swearing allegiance with one hand whilst strangling democracy with the other, President John Fitzgerald Kennedy PUBLISHED.
It seems the court was documented as predominantly jailing and working to death persons who had committed no crime other than poverty. Vagrancy got most people worked to death in prison labor at "hard labor" killed. The time it took to die on such "pomgroms" was a tad under two years on average. Practically nobody was ever released either.
So to recap: for the majority of US history the US judiciary have been mass murderers who denied justice to 75% of those they ritually murdered on chain gangs and alike. These victims didn’t get "phone calls". These victims didn’t get "Lawyers". These victims didn’t get "appeals" or "Haebius Corpus" rights. In short they got a summary hearing ~ if that ~ and were then worked to death whilst on a starvation diet.
This was the era of the "Greatest Period in American Justice" Ron Wilson Reagan promised before the 1980 election to RESTORE.
And, after the election, George Walker Bush reinstated Chain Gangs in Texas, after nearly 20 years of freedom from such violent murderous oppression purchased for us by the deaths of JFK and his brother RFK (who actually did most of the leg work for the Prison Report). Conserfatives were merely to timid to carry on mass murder after that, until people had forgotten.
