How much jail time could someone get if convicted of rape?
If a 16 year old boy rapes a girl his age in the state of California, how many years (months) in jail does he have to face if proven guilty?
BTW I know he has to go to juvie first but after that how many years (months) of jail rime could he get?
The maximum sentence for an adult for rape, absent any other aggravating factors, is eight years in prison. (Pen C 264.) A 16 year old could be prosecuted as an adult for this offense. If he remained in juvenile, and was not sent to a state facility ("juvenile prison"), court jurisdiction would end when he turns 21 (i.e., 5 years), but if he went to a state facility, jurisdiction could last to age 25, and the maximum period of confinement would be the same as for an adult, eight years.
It really depends on the courts and the events surrounding the crime. Generally speaking, due to the individuals age he would be released by 18 with some probation and sex offender registration.
