How much jail time should I expect for my ex-boyfriend to receive for aggravated assault and battery?
My ex-boyfriend was very abusive to me and he stabbed me and got off with simple assault. Yes, I said simple asssault. He was given a 1 year sentence and he got out in 6 months on probation. He recently beat me up and was arrested again and this time they are charging him with aggravated assault and battery because of the violation and all that. What should I expect? Long jail term or short? We live in Monroe, Louisiana.
Louisiana works under Napolionic law and is different than any other of the 50 states. Still I would think he should be looking at 3-5 years minimum with apossible enhancement for domestic abuse with a weapon involved. Seek a permanent restraining order through the courts and make sure that any further contact with you (by phone, mail, in person, or through a 3rd party) is a violation of the order. Your local domstic violence agency should be all over this and be helping you. Seek them out and make sure the prosecutor doesn’t give in to a plea bargain that gives him anything less than the maximum time in jail.
2nd offense. It depends on his lawyer. But Id say at least another 6 mos. to a year.

that’s messed up. im sorry to hear about it. I would think he would be charged with attempt murder and battery for stabbing you. he should have been in jail for a bit.

I don’t understand why he’s still alive, don’t Louisiana have the right to pack? You have to understand that the law will not protect you, not because they don’t want to but because they can’t. The guy will beat you to death before the cop down at the station gets his car cranked.
